The court found that the appellant did not apply for or obtain leave to appeal after the application for review was dismissed. The law under Order 44 rule 2 of the Civil Procedure Rules requires that an appeal from an order refusing review may only be filed with leave of court. Although leave can be sought formally or informally, there was no evidence on record that any such application was made or granted in this case. As a result, the appeal was found to be incompetently before the court, and the preliminary objection was upheld. The appeal was dismissed with costs.
