Ratio Decidendi

The court found that the 3rd December 2019 loan agreement did not comply with the mandatory requirements of the Tier 4 Microfinance Institutions and Money Lenders Act, 2016. The agreement failed to specify the principal and interest rate as required, and the plaintiff did not produce statutory records of the transaction. Evidence showed no money was actually disbursed on the date of the agreement, and the computation of the claimed sum was unsupported. The court held that the transaction was illegal, harsh, and unconscionable, and therefore unenforceable. Applying the principle that courts will not enforce illegal contracts, the plaintiff's claim was dismissed in its entirety.
