The Plaintiff was therefore entitled to foreclose and sell the mortgaged property to recover the outstanding sum. However, the court held that consent to sale by private treaty must be given by the mortgagor at the time of sale and not retrospectively in the mortgage deed, as per Regulation 10 of the Mortgage Regulations.
