The court held that although the administration contracts contained an arbitration clause, the insolvency process is governed by statutory provisions that take precedence during liquidation. Section 97(1)(c) of the Insolvency Act prohibits the commencement or continuation of proceedings against a company in liquidation, and the process for proving debts is set out in the Insolvency Act and Regulations. The applicant, as an alleged creditor, was required to submit its claim to the liquidator, who in turn was obliged to verify the claim.
