The Court of Appeal found that while the trial judge did not act illegally or on a wrong principle, the sentence of 45 years imprisonment for a 60-year-old first offender was manifestly harsh and excessive compared to sentences in similar cases. The court considered the appellant's age, status as a first offender, time already spent in custody, and evidence of reformation. Applying the principles from Kiwalabye Bernard v. Uganda and Adukule Natal v. Uganda, the court determined that there was sufficient reason to interfere with the sentence. The sentence was accordingly reduced to 20 years imprisonment as appropriate in the circumstances, while the conviction was upheld.
