The Respondents filed their Written Statement of Defence and counterclaim nine days out of time without seeking leave of court. The court found no sufficient cause or ground for the delay, and the Respondents' reliance on mistake of counsel was not justified as there was laxity and lack of diligence. The court held that procedural rules must be followed and that its discretion to enlarge time is only exercisable where sufficient reason is shown. Since the Respondents failed to demonstrate sufficient cause and engaged in dilatory conduct, the application to strike out the defence and counterclaim was allowed.
