The court found that the suit property constitutes family land under Section 39(4)(a) of the Land Act Cap.236, as it is the ordinary residence of the Applicant and his family. However, since the Applicant and the 1st Respondent were never legally married and the other Respondents are adult children, none of the Respondents qualifies as a spouse under the Act. The law requires consent for transactions on family land only from a spouse, not from children or non-spouses.
