The Court of Appeal held that the High Court's revisionary jurisdiction under Section 50 of the Criminal Procedure Code Act does not permit the setting aside of an acquittal order except where the acquittal was not the result of a proper trial. In this case, the trial Magistrate acquitted the appellants without conducting a trial after they pleaded not guilty, which was a procedural error. The High Court acted within its supervisory powers to correct this error by remitting the case for proper trial or withdrawal of charges.
