Ratio Decidendi

The court found that the transfers of Kyadondo Block 196 Plot 178 from the plaintiff to the first defendant, and subsequently to the second defendant, were fraudulent, based on forged documents and misrepresentations while the plaintiff was abroad. The mortgage to Stanbic Bank was also fraudulent and invalid, as the bank failed to conduct proper due diligence regarding the true occupier and status of the property. The plaintiff's continuous occupation since 1965 was unchallenged, and the defendants failed to rebut the evidence of fraud. The court held that fraud unravels all transactions and that neither the second nor third defendant could claim bona fide status without proper inquiry....
