Ratio Decidendi

The Respondent's caveat was originally justified by her family's entitlement to a share of the estate. However, the inventory filed in court shows that the Respondent's family has been allocated its share, and there is no evidence that the Applicant, as administrator, will fail to distribute according to the inventory. The administrator cannot effectively distribute the estate while the caveat remains, and the continued maintenance of the caveat is no longer justified. Therefore, the caveat must be removed to allow the administrator to perform his duties and distribute the estate to all beneficiaries.
