The applicant had filed a notice of appeal, demonstrated a likelihood of success, and shown that substantial loss would result if execution proceeded before the appeal was heard. The application was made without unreasonable delay. The respondent would not suffer prejudice if execution was stayed, as she would only have to wait for the outcome of the appeal. In the interest of justice, the court granted an interim order of stay of execution pending the final determination of the taxation appeal.
