The court found that the 1st defendant had already relinquished all proprietary interest in the suit land by endorsing the sale agreement of 17th November 2001, which transferred the entire 400-acre tract (including the disputed 10 acres) to the 2nd defendant. Consequently, the 1st defendant could not pass good title to the plaintiff in 2002. The plaintiff, therefore, had no locus standi to sue the 2nd and 3rd defendants, and the suit against them was dismissed. However, the 1st defendant's misrepresentation of title and receipt of Ushs. 20,000,000/= constituted unjust enrichment.
