Procedural Posture

Taxation Appeal / Ruling

  1. 1 Whether the award of Ugx. 14,995,000/= as instruction fees is justifiable.
  2. 2 Whether the award of Ugx. 23,194,000/= as the total bill of costs contravenes the principles governing taxation of costs.

Ratio Decidendi

The court found that the instruction fee awarded was not excessive given the appreciation of the suit land since 1999 and the nature of the appeal. The taxing master exercised proper discretion in awarding Ugx. 14,995,000/= as instruction fees. However, the inclusion of costs from the lower court in the bill of costs was improper, as there was no order awarding such costs. Items 24 to 31 of the bill, amounting to Ugx. 3,130,000/=, were struck out, and the total award was reduced to Ugx. 20,064,000/=. The respondent is entitled only to costs for the appeal, not for the lower court proceedings. No order was made as to costs in the instant appeal due to non-service of the respondent.

Court Disposition

Orders

  • Items 24 to 31 of the bill of costs are struck out.
  • The total costs of Ugx. 3,130,000/= are deducted from the award.
