The assignment of the suit kibanja from Maria Nalugwa to Sseruwu Michael was invalid and ineffective, as it was made without the required consent of the registered owners and without giving them the first option to purchase, in contravention of the Land Act. The respondent, as assignee of Sseruwu Michael, acquired no legally recognized interest in the suit kibanja. The purported sale of the kibanja to the appellants was not satisfactorily proven, and the evidence supporting it was discredited by the trial Judge, whose impressions of witness credibility are given deference.
