The court found that the respondents were in contempt of court by re-entering and developing the suit land in violation of a permanent injunction and the order for stay of execution, which was intended to preserve the status quo pending appeal. The respondents failed to provide sufficient proof of compliance with the condition to deposit Ug shs 30,000,000 as security for due performance, as a bank draft alone did not constitute payment without evidence of receipt. The failure to comply with this condition automatically vacated the stay of execution.
