The trial judge erred in failing to rule on the counter-claim, which was unproven and should have been dismissed with costs. On interest, the court found that the appellant was entitled to interest on the principal sum for the period prior to the institution of the suit at a reasonable rate, not the commercial rate claimed, and set this at 20% per annum from the date of dismissal to the date of filing the...
