Ratio Decidendi

The Court of Appeal held that the trial judge, in sentencing the appellant to 25 years imprisonment for aggravated defilement, considered the period spent on remand as required by the law applicable at the time (2010). Although the judge did not mathematically deduct the 20 months spent on remand, he acknowledged it as a mitigating factor in determining the sentence. The rule requiring arithmetical deduction of the remand period was established in Rwabugande Moses v Uganda in 2017 and does not apply retrospectively to sentences imposed before that decision.
