The appeal was dismissed on a preliminary point of law. The grounds of appeal were found to be too general and did not comply with Order 43 Rule 1 and 2 of the Civil Procedure Rules, which require that grounds of objection to a decision be set forth concisely and specifically. The court adopted the reasoning in prior Ugandan appellate decisions that general grounds are impermissible and send the court on a fishing expedition. As such, the appeal was struck out and costs awarded to the respondents. The merits of the underlying dispute regarding ownership and trespass to land were not reached due to the procedural defect.
