The mix-up in dates and late filing of Supreme Court Civil Appeal No. 16 of 2001 was due to the mistake, error, or inadvertence of the applicants' former counsel and/or court officials, not the applicants themselves. The court reaffirmed that such mistakes should not be visited on the litigant. Under Rule 4, the court has discretion to extend time even after the act has been done, and documents filed out of time may be validated by such extension.
