Ratio Decidendi

The tribunal found that while the applicant failed to prove he was subjected to torture or cruel, inhuman, or degrading treatment, there was clear evidence that he was detained for thirteen days without being brought before a court, in violation of Article 23(4)(b) of the Constitution. The initial two days of detention were lawful, but the subsequent eleven days constituted illegal detention. The respondent, as the representative of the government, was held vicariously liable for the violation of the applicant's right to personal liberty.
