Ratio Decidendi

The Tribunal determined that the appointment of a valuation surveyor and the determination of compensation are acts of execution of the High Court judgment and decree. The interim order issued by the High Court expressly stayed execution of the judgment and decree, which includes the Tribunal's mandate under clause 7 of the decree. The Tribunal found that the stay order applies in toto to all acts implementing the judgment, including proceedings before the Tribunal. Therefore, the Tribunal must respect the consent order for stay and suspend its proceedings until the expiry of the stay period.
