The risk of auctioning the vehicle before determination of the main suit constitutes irreparable injury, as disposal would render assessment of damages and tax obligations impossible. The Respondent's statutory powers under the EACCMA do not divest the Court of jurisdiction to investigate alleged negligence or unlawful conduct. The balance of convenience favours preserving the status quo to prevent prejudice to the Applicant. All conditions for grant of a temporary injunction are satisfied, and the application is allowed.
