The operative court order restrained the Respondent from implementing the termination letter dated 10th May 2021 pending the hearing of the main suit. The Respondent's actions in amending the contract and restructuring business operations were necessitated by statutory requirements under the National Payment Systems Act, which mandated separation of GSM and mobile commerce businesses. The amendments did not amount to termination of the contract and were not in contempt of the court order. The Applicant failed to prove wilful non-compliance with the specific terms of the injunction. Therefore, the Respondent was not in contempt of court.
