[1931] EACA 5

The Court of Appeal held that the trial judge erred by treating himself as bound by the arbitrator's recommendation on costs and by failing to exercise the judicial discretion required by law. The arbitrator's award was only a recommendation, and the judge was obligated to independently consider and determine the appropriate order as to costs. Since the plaintiffs succeeded in their claim and the defendants' counterclaim failed, the plaintiffs were entitled to costs on the subordinate court scale, and the defendants were not entitled to any costs. The judge's order was therefore varied to reflect this, and the appeal was allowed with costs to the appellants.
