Criminal Appeal / Appeal Against Sentence

  1. 1 Whether the sentence of 25 years imprisonment for murder was harsh, manifestly excessive, and inconsistent with previous judicial precedents.
  2. 2 Whether the trial Judge failed to consider the consistency and uniformity principle in sentencing.

Ratio Decidendi

The Court of Appeal held that the sentence of 25 years imprisonment for murder was within the sentencing range for similar offences and consistent with the principle of uniformity and consistency in sentencing. The trial Judge considered both aggravating and mitigating factors, as well as the period spent on remand. The appellate court found no evidence that the trial Judge acted on a wrong principle, overlooked material facts, or imposed a manifestly harsh or excessive sentence. Previous authorities supported sentences ranging from 20 to 35 years for murder, and the sentence imposed was neither harsh nor excessive. The appeal was dismissed and the sentence upheld.
