The expiration of letters of probate or administration does not automatically extinguish the responsibilities or liabilities of administrators in relation to ongoing suits involving the estate. While Section 337(2) of the Succession Act, Cap 268, provides for expiry, the court retains inherent powers under Section 98 of the Civil Procedure Act and Article 126(2)(e) of the Constitution to extend the mandate of administrators to ensure substantive justice and prevent evasion of responsibility. The court found that allowing the administrators to withdraw due to expiry would defeat the legislative intent of accountability and timely administration, and would prejudice the Plaintiff....
