The court held that the Equal Opportunities Commission Act and its Regulations require appeals to the High Court to be filed within thirty days of the decision. The appellant filed the appeal after the statutory period had elapsed and did not seek leave of court to file out of time. The court found that there is no inherent appellate jurisdiction and that appeals are strictly creatures of statute. Where the statute and regulations are silent on the procedure after expiry of time, the ordinary rules of the court may apply, but a separate application for extension of time is required.
