The High Court found that the Applicant lawfully purchased the suit land from the Respondent, a fact not denied by the Respondent, and was twice declared owner by competent courts: first by the LC1 Court and subsequently by the Chief Magistrate’s Court of Bundibugyo. The subsequent eviction of the Applicant, based on a judgment in a suit to which she was not a party, was irregular and contrary to the doctrine of res judicata, which bars re-litigation of matters already conclusively determined between the same parties.
