The court found that the appeal sought to be re-admitted was incompetent because it was not accompanied by a proper decree as required by the Civil Procedure Rules. The document attached to the memorandum of appeal did not bear the date of the judgment delivered, rendering it irrelevant. As a result, there was no competent appeal in place and, therefore, no chances of success for the applicant. The court held that even if the dismissed appeal was re-admitted, it would remain incompetent. Other grounds raised by the applicant were rendered moot by this fundamental procedural defect. The application was dismissed with costs.
