Ratio Decidendi

The Registrar dismissed the suit for want of prosecution on application by the defendant under O.15 r.6 of the Civil Procedure Rules. However, precedent establishes that O.15 r.6 does not entitle a defendant to move for dismissal; only the court may do so on its own initiative. The application by the respondents' advocates was therefore misconceived, and the resulting dismissal order was a nullity. The court found no authority overruling this position and was persuaded by the reasoning in Pirbhai Lalji & Sons Ltd vs. Hadsanali Devji. Consequently, the court set aside the dismissal order and reinstated the suit. The applicant was denied costs due to lack of diligence in prosecuting the suit.
