Ratio Decidendi

The appellate court found that the defendant's occupation of the suit land predated the plaintiff's acquisition of leasehold title. The defendant demonstrated a long-standing, unregistered but registrable interest in the land, supported by documentary evidence and credible witness testimony. The doctrine of indefeasibility of title does not override such interests, and the plaintiff's title is subject to the defendant's prior possession. The trial magistrate erred by failing to recognize the legal effect of the defendant's occupation and interest, and by treating the registered leasehold as conclusive. The appeal was allowed, and the trial court's judgment and orders were set aside.
