Taxation Appeal / Ruling

  1. 1 Whether the learned Registrar erred in law and fact in awarding manifestly excessive and unreasonable instruction fees to the Respondent.
  2. 2 What remedies are available to the parties.

Ratio Decidendi

The court found that the learned Registrar followed the law on taxation, applying the correct principles and using the ascertainable value of the subject matter from the pleadings to calculate instruction fees. The dismissal of the suit disposed of the entire matter, and the taxation was conducted in accordance with the Advocates (Remuneration & Taxation of Costs) Regulations. No error of principle was identified in the assessment of fees, and the amount, though appearing excessive, was justified by the final disposal of the suit. The appeal therefore lacked merit and was dismissed.
