The Court of Appeal found that the trial judge failed to properly deduct the period the appellant spent on remand from the sentence, as required by Article 23(8) of the Constitution and the Supreme Court's guidance in Rwabugande v. Uganda. This omission rendered the sentence illegal. The appellate court set aside the original sentence and, after considering aggravating and mitigating factors, imposed a fresh sentence of 20 years imprisonment. From this, the period of 2 years and 1 day spent on remand was deducted, resulting in a final sentence of 17 years, 11 months, and 29 days imprisonment from the date of conviction.
