The trial Magistrate erred in awarding parking and security fees that were neither pleaded nor proved, and in treating acknowledgments of payment as a sale agreement. The Respondent, having released the vehicle to the Appellant upon initial payment, lost any right of lien and was not entitled to impound the vehicle or claim storage fees. The impounding was illegal and deprived the Appellant of both the vehicle and the use of his money. The Appellant was justified in rescinding the contract and entitled to a refund of payments made, special damages for repairs, general damages for deprivation, and interest.
