The court found that the counterclaimants' cause of action in fraud was time-barred under Section 5 of the Limitation Act, as the alleged fraud was discovered by their predecessor in 1959, and the statutory period had long expired. The plaintiffs were bona fide purchasers for value without notice of any fraud, having acquired the land from a lawfully registered proprietor. The Commissioner Land Registration acted ultra vires in cancelling the plaintiffs' certificates of title on grounds of fraud, as Section 91 of the Land Act does not confer such power.
