The letter dated 8/8/2018 from the appellant expressed an intention to renew the contract subject to a satisfactory appraisal, which was not conducted. The court held that the absence of an appraisal and the lack of evidence that the respondent worked beyond the contract expiry date meant that the contract lapsed automatically. The Labour Officer erred in finding that there was an unlawful or unfair termination and in awarding compensation. The appeal was allowed, and all compensation orders by the Labour Officer were set aside.
