The law prohibits departure from pleadings except by amendment. This inconsistency undermined the credibility and authenticity of the plaintiff's claim. Consequently, the plaintiff failed to prove ownership of the suit land on the balance of probabilities. With issue one resolved against the plaintiff, the court found no reason to address the remaining issues. The suit was dismissed.
