Ratio Decidendi

The defendant failed to discharge his statutory duties as administrator by not filing inventories or accounts for the estates, selling estate property without the knowledge or consent of the beneficiaries, and failing to distribute proceeds from the sale. These omissions constitute mismanagement under the Succession Act and jeopardize the beneficial interests of the plaintiffs. The court found the defendant unsuitable to continue as administrator and ordered revocation of the grants, issuance of fresh letters of administration to two plaintiffs, and an injunction restraining the defendant from further administration of the estates.

Court Disposition

Orders
