The High Court held that while Section 49 of the Civil Procedure Act generally provides that a judicial sale becomes absolute upon payment of the full purchase price, this rule is subject to exceptions where there is a material irregularity in the execution process. In this case, the ex parte judgment upon which the execution and sale were based was set aside for violating the Respondent's right to be heard, a fundamental principle of natural justice. The appellate court found that the trial Magistrate correctly relied on the decision of Hon. Lady Justice H. Wolayo, which confirmed that setting aside the ex parte judgment nullified the legal basis for the execution and subsequent sale....
