Ratio Decidendi

The Tribunal denied approval for withdrawal of the application because the purported compromise and new decision by the Chief Administrative Officer were unlawful. The Chief Administrative Officer was functus officio after making the initial administrative review decision, and could not lawfully issue a new decision while an appeal and suspension order were pending before the Tribunal. Furthermore, the Contracts Committee could not lawfully make a new award decision without a re-evaluation by the Evaluation Committee. Since the withdrawal was premised on an unlawful compromise, the Tribunal struck out the application and made no order as to costs.
