Ratio Decidendi

The applicant failed to satisfy all the mandatory conditions for grant of a stay of execution pending appeal as set out in Order 43 rule 4(3) of the Civil Procedure Rules. Although a notice of appeal was filed and the application was made without unreasonable delay, the applicant did not provide evidence of substantial loss nor furnish any security for due performance of the decree. The absence of security and the delay in pursuing the appeal indicate a lack of seriousness and suggest the application was intended to frustrate the respondent's realization of costs. The court found no basis to grant the stay and dismissed the application with costs to the respondent.
