Procedural Posture

Miscellaneous Cause / Ruling on Ex Parte Application for Vesting Order

  1. 1 Whether the applicant is entitled to a vesting order in respect of Plot 1032 Block 244, Kyadondo, Diplomat Rise, Muyenga.
  2. 2 Whether section 77 of the Registration of Titles Act applies to the applicant's circumstances.
  3. 3 Whether the applicant has proved recovery of land from the registered proprietor as required by law.

Ratio Decidendi

The court found that section 77 of the Registration of Titles Act applies only where a party has recovered land from the registered proprietor through proceedings. In this case, the applicant failed to demonstrate that he had recovered the land by any such proceedings, as the previous suit regarding the property was dismissed for want of prosecution and not decided on the merits. Therefore, the applicant did not meet the legal requirements for a vesting order. The application was misconceived and amounted to an abuse of court process, as the applicant failed to prove entitlement to the land on the balance of probabilities.
