The trial Magistrate failed to properly evaluate the defences of accident, claim of right, and alibi raised by the Appellants. The prosecution did not rebut these defences, nor did the investigating officer verify the plausibility of accidental damage or the claim of right over the disputed land. The second Appellant's alibi was not investigated or disproved. The omission to consider these defences constituted a gross miscarriage of justice, negating the element of mens rea required for conviction under Section 335(1) of the Penal Code Act. Consequently, the conviction and sentence were quashed, and the Appellants were acquitted.
