The court found that the Applicant had demonstrated a prima facie case with triable issues regarding ownership of the suit land, and that the Respondents, having fraudulently transferred the property, were likely to dispose of it, causing irreparable harm to the Applicant. The Respondents failed to respond to the Application, and the balance of convenience favoured the Applicant. The court held that all the requisite ingredients for granting a temporary injunction were satisfied, and preservation of the status quo was necessary until determination of the main suit.
