The High Court found that the trial magistrate failed to follow the mandatory procedural steps set out in section 83 of the Magistrates Courts Act before committing the applicant, a surety, to civil prison for failure to forfeit the bond. Specifically, the magistrate did not call upon the applicant to show cause why the bond should not be forfeited, did not issue a warrant of attachment and sale of the applicant's property, and did not provide the applicant with an opportunity to be heard, as required by law and the Constitution.
