The Registrar has discretion to award costs in execution proceedings even if no formal request is made, as costs generally follow the event. The process of execution under the Civil Procedure Rules explicitly contemplates costs for taking out execution. However, the award of UGX 1,000,000/= as costs was improper because it was not taxed in accordance with Section 38 of the Advocates Act. The law requires party-to-party taxation to determine the quantum of costs. Therefore, the order awarding UGX 1,000,000/= is set aside, and the Respondents are directed to file a bill of costs for taxation. The Applicant is not entitled to costs of this application, as the Respondents were not at fault...
