The Court of Appeal found that the trial judge erred in law by failing to deduct the period the appellant spent on remand prior to conviction, as required by Article 23(8) of the Constitution. Additionally, the judge failed to properly consider the appellant's age (18 years at the time of the offence) and other mitigating factors, such as the absence of loss of life. The court held that these errors warranted interference with the sentence. The sentence of 20 years imprisonment was set aside and substituted with a sentence of 15 years, further reduced by the remand period, resulting in a final sentence of 14 years imprisonment from the date of conviction.
