Ratio Decidendi

The court found that although a stay of execution was granted on condition that the applicants deposit security for due performance of the decree within thirty days, the applicants failed to comply within the stipulated period. The security was deposited more than a month and a half after the deadline, and the applicants did not seek a formal extension from the court. The court held that the stay of execution lapsed due to non-compliance with the condition, and thus there was no operative order that could be the basis for contempt. The respondents could not be held in contempt of a lapsed order. The application was therefore dismissed with costs to the respondents.
