The Court found that none of the questions raised by the applicant, whether relating to the effect of lease expiry, powers of attorney, expunging of evidence, or fair trial rights, constituted questions of law of great public or general importance as required for certification under Section 6(2) of the Judicature Act. The primary findings of fact had been sufficiently investigated by three courts, and the alleged errors did not warrant further appellate review. The Court also held that it lacked jurisdiction to stay execution of its judgment in the absence of a pending appeal. Accordingly, both applications were dismissed with costs to the respondents.
