Ratio Decidendi

The plaintiff is the lawful Kibanja holder of the suit land, having purchased it in 1995 and maintained continuous, peaceful possession. The defendants unlawfully entered the land in 2014, destroyed crops, and were convicted of criminal trespass and malicious damage. The evidence of ownership and possession by the plaintiff is uncontroverted. The defendants' actions constituted trespass, and the plaintiff is entitled to general damages for loss suffered, punitive damages for the defendants' highhanded conduct, and costs. The court awards general damages of UGX 5,000,000 at 10% interest per annum from judgment until payment, punitive damages of UGX 3,000,000, and costs to the plaintiff....
